Chronology of OCS Civil Penalties Program

The goal of the OCS Civil Penalties Program is to assure safe and clean operations on the OCS. Through the pursuit, assessment, and collection of civil penalties, the progrm is designed to encourage compliance with OCS statutes and regulations.

  • May 4, 2021: BSEE increases the maximum civil penalty rate from $45,463 to $46,000 a day for each OCSLA violation, and issues NTL 2021-N01 Revised OCSLA Civil Penalty Assessment Matrix
  • March 4, 2020: BSEE increases the maximum civil penalty rate from $44,675 to $45,463 a day for each OCSLA violation, and issues NTL 2020-N02, Revised OCSLA Civil Penalty Matrix.
  • March 25, 2019: BSEE increases the maximum civil penalty rate from $43,576 to $44,675 a day for each OCSLA violation, and issues NTL 2019-N03, Revised OCSLA Civil Penalty Matrix.
  • January 19, 2018: BSEE increases the maximum civil penalty rate from $42,704 to $43,576 a day for each OCSLA violation and issues NTL 2018-N01, Revised OCSLA Civil Penalty Assessment Matrix.  
  • February 3, 2017: BSEE increases the maximum civil penalty rate from $42,017 to $42,704 a day for each OSCLA violation and issues NTL 2017-N01, Revised OCSLA Civil Penalty Assessment Matrix.
  • July 28,  2016: BSEE increases the maximum civil penalty rate from to $42,017 a day for each OCSLA violation and issues NTL 2016-N05, Revised OCSLA Civil Penalty Assessment Matrix.
  • November 2015: Congress passes  Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015, stating that every agency must update their civil penalty amounts by July 2016 and annually every year after.
  • July 2011: Issued an NTL providing the revised civil penalty assessment matrix. (NTL 11-5N)
  • June 2011: Final rule published in the Federal Register. This rule raises the maximum penalty to $40,000 per violation per day and was effective July 30, 2011. (2011 FR 38294)
  • January 2010: Notice summarizing review of the maximum daily civil penalty assessment. (75 FR 1076)
